Terms of Service

These Terms of Service (hereinafter referred to as “these Terms”) set forth the conditions for using the mobile application “Tokutsum” (hereinafter referred to as “this Service”) provided by Shimateku Inc. (hereinafter referred to as “the Company”). To use this Service, you must agree to these Terms.
Article 1 (Application)
- These Terms shall apply to all relationships regarding the use of this Service between users and the Company.
- If the Company separately establishes usage rules on this Service, they shall constitute part of these Terms.
- In case of any discrepancy between the provisions of these Terms and the usage rules in the preceding paragraph, the usage rules shall prevail.
Article 2 (Registration)
- Those who wish to use this Service (hereinafter referred to as “Registration Applicants”) shall apply for registration in the manner prescribed by the Company after agreeing to these Terms.
- The Company may not approve registration if it determines that a Registration Applicant has any of the following reasons:
- If false information was provided during the registration application
- If the application is from someone who has previously violated these Terms
- If the application is from a minor, adult ward, person under curatorship, or person under assistance without consent from their guardian, curator, or assistant
- If the Company otherwise deems the registration inappropriate
Article 3 (Service Content)
This Service provides the following features based on Buddhist teachings:
- Merit Recording Feature: Function to record and share users' good deeds and practice experiences
- Meditation and Practice Support: Meditation timer, sutra reading guide, practice progress tracking
- Six Realms Reincarnation System: Afterlife prediction and karma analysis based on user actions
- Community Features: Interaction with practice companions, information sharing, event participation
Article 4 (Usage Fees and Payment Methods)
- Basic features of this Service are available free of charge.
- Some advanced features may be offered as paid plans.
- Fees and payment methods for paid plans shall be separately determined within this Service.
- Paid fees are non-refundable for any reason unless otherwise specified by the Company.
Article 5 (Prohibited Actions)
Users must not engage in the following actions when using this Service:
- Actions that violate these Terms
- Actions that violate laws or public order and morals
- Actions related to criminal activities
- Providing benefits or cooperation to anti-social forces
- Actions that infringe intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other users, or third parties
- Collecting or accumulating personal information about other users
- Posting violent, obscene, threatening, fraudulent, discriminatory, prejudiced, hateful, or defamatory information on this Service
- Using this Service for commercial purposes or attempting to gain economic benefits in ways not intended by the Company
- Intentionally posting false good deed records or practice experiences
- Inciting religious conflicts or defaming specific denominations
- Impersonating other users
- Making unreasonable inquiries or demands to the Company and its employees
- Actions that damage the trust, brand, or image of the Company or this Service
- Actions that interfere with the server or network system of this Service
- Illegally manipulating this Service using technical means
- Transmitting computer viruses or other harmful programs
- Intentionally exploiting bugs in this Service
- Actions that interfere with the operation of this Service or other users' use
- Other actions deemed inappropriate by the Company
Article 6 (Content Handling)
- Intellectual property rights to content posted by users on this Service (good deed records, practice experiences, photos, comments, etc., hereinafter “User Content”) belong to the users.
- Users grant the Company permission to use User Content for purposes of operating, improving, and promoting this Service.
- The Company may delete User Content without prior notice if it determines the content:
- Violates these Terms
- Violates laws
- Violates public order and morals
- Infringes on others' rights
- Significantly contradicts Buddhist teachings
Article 7 (Service Suspension)
- The Company may suspend or interrupt all or part of this Service without prior notice to users if it determines any of the following circumstances exist:
- When performing system maintenance, inspection, or updates
- When service provision becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- When systems or communication lines stop due to accidents
- When the Company otherwise determines service provision is difficult
- The Company shall not be liable for any disadvantages or damages suffered by users or third parties due to suspension or interruption of this Service.
Article 8 (Usage Restrictions and Registration Cancellation)
- The Company may restrict all or part of the use of this Service or cancel user registration without prior notice if a user:
- Violates any provision of these Terms
- Is found to have provided false registration information
- Defaults on payment obligations
- Does not respond to Company communications for a certain period
- Has not used this Service for a certain period since last use
- The Company otherwise deems use of this Service inappropriate
- The Company shall not be liable for any damages incurred by users due to actions taken by the Company under this article.
Article 9 (Privacy Protection)
- The Company handles personal information in accordance with its separately established Privacy Policy to properly protect users' personal information.
- Spiritual and religious information such as meditation records and good deed records will be handled with particular care.
Article 10 (Disclaimer)
- The Company does not explicitly or implicitly guarantee that this Service is free from factual or legal defects (including defects, errors, bugs, and rights infringements related to safety, reliability, accuracy, completeness, effectiveness, fitness for specific purposes, and security).
- The Company shall not be liable for non-performance of obligations due to circumstances beyond its control, including natural disasters, war, riots, civil unrest, terrorism, fire, explosion, epidemic, enactment or amendment of laws, orders or measures by public authorities.
- The Company shall not be liable for any damages suffered by users in connection with this Service. However, this disclaimer shall not apply if the contract between the user and the Company regarding this Service is a consumer contract as defined by the Consumer Contract Act, except in cases of gross negligence by the Company.
- The Company shall not be liable for any mental or religious changes or effects resulting from the use of this Service.
Article 11 (Service Changes)
- The Company may change the content of this Service or discontinue its provision without notifying users, and shall not be liable for any damages incurred by users as a result.
Article 12 (Changes to Terms)
- The Company may change these Terms at any time without notifying users if deemed necessary. Users who begin using this Service after changes to these Terms are deemed to have agreed to the changed terms.
Article 13 (Personal Information Handling)
- The Company shall appropriately handle personal information obtained through the use of this Service in accordance with the Company's Privacy Policy.
Article 14 (Notifications and Communications)
- Notifications or communications between users and the Company shall be made in the manner prescribed by the Company. Unless the Company receives a change notification in the separately prescribed format, the Company shall consider the currently registered contact information valid and send notifications or communications there, which shall be deemed to have reached the user upon transmission.
Article 15 (Prohibition of Transfer of Rights and Obligations)
- Users may not transfer their position under the usage contract or rights or obligations under these Terms to third parties or provide them as collateral without prior written consent from the Company.
Article 16 (Governing Law and Jurisdiction)
- These Terms shall be governed by Japanese law.
- Any disputes arising in connection with this Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's head office location.
